The short version. Play the game, enjoy it, don't cheat it apart and resell it. Anything you buy is a virtual item inside the game with no cash value, and refunds go through Google Play. The game is provided as it is, with no promises that it will be perfect or available forever.
Please read this bit. Cloud backup to your Google Play Games account is optional and per world - a world without it turned on lives only on this device. Deleting a world is permanent and takes any purchased benefits in it with it. Use EXPORT on the Worlds screen to keep a backup regardless of whether cloud backup is on.
1. Agreement
These Terms of Use ("Terms") are an agreement between you and Rafferty Software LLC ("we", "us") covering the Dirt Empire Android application ("the game"). By installing or playing the game you accept these Terms. If you do not accept them, do not install or play it.
The game is distributed through Google Play, so Google Play's own terms apply to you as well. Where Google Play's terms give you a right — a refund right, for instance — nothing here takes it away.
2. Your licence to play
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play the game on devices you own or control, for your own non-commercial entertainment. That is the whole of the licence.
You agree not to:
- copy, sell, rent, sublicense or redistribute the game or any part of it;
- reverse engineer, decompile or modify the game, except where that right cannot lawfully be excluded;
- strip out, obscure or alter any copyright or ownership notice;
- use cheats, automation, memory editors or modified builds to alter progress or obtain paid items without paying for them;
- use the game to break the law, or to interfere with Google Play's services.
3. What we own
The game, including its code, artwork, pixel fonts, sound effects, music and name, is owned by Rafferty Software LLC and protected by copyright. Nothing in these Terms transfers ownership of any of it to you. Screenshots and video of your own play — for reviews, streams or videos — are welcome and permitted.
4. Purchases and virtual items
The game offers optional one-time in-app purchases. They are conveniences and shortcuts; the game can be completed without buying anything.
- All purchases are processed by Google Play. We never handle your payment details.
- What you receive is a licence to use a virtual item inside the game, not ownership of property. Dirt, shards, upgrades and every other in-game value have no monetary value, cannot be exchanged for money, and cannot be transferred, sold or traded outside the game.
- Purchases are tied to the Google account that bought them. Non-consumable items can be restored with "Restore Purchases" in the in-game store. Consumable items, such as the Dirt Crate, are used up when granted and can be bought again.
- Refunds are handled by Google Play under its refund policy. We cannot issue refunds ourselves, though we are glad to help if something did not deliver — write to us.
- We may change prices, add items, or retire items from sale. Items you have already bought stay available to you in the game for as long as the game itself is supported.
5. Your save data
Cloud backup to Google Play Games is optional and set per world from the Worlds screen. A world with it off exists only on the device you are playing on - nothing is backed up anywhere, including to us; we never hold a copy of your save. A new world backs up automatically once you are signed in, and a fresh install offers to bring back worlds you previously backed up on another device.
We cannot restore a save we never had a copy of, so progress in a world that never had cloud backup on is gone for good if it's lost to a wiped device, an uninstall, cleared app storage or a deleted world. Use EXPORT on the Worlds screen to keep your own backup file regardless of your cloud backup setting. See the Privacy Policy for the detail on what syncs and when.
6. Deleting a world
The game lets you delete a world, and deletion is permanent and immediate. It cannot be undone by us, and we cannot recover a deleted world for you.
Deleting a world also removes everything held inside that world's save, which includes any benefits that came from a purchase and applied only to that world — for example dirt or shards paid out by a Starter Crate or Dirt Crate, and per-world items such as Foreman's Cut or the 24 Hour Shift as they applied to that mine.
To the fullest extent permitted by law, Rafferty Software LLC is not responsible for the loss of any in-game currency, items, upgrades, progress or purchased benefits arising from a world being deleted, whether that deletion was accidental or intentional, and whether performed by you or by anyone with access to your device. No refund, restoration, credit or replacement is owed for such a loss. This does not affect any refund right you may have directly from Google Play, or any right that cannot lawfully be excluded.
Two things reduce this risk, and both are your choice to use: permanent, non-consumable purchases can be re-applied with "Restore Purchases" in the in-game store, and EXPORT on the Worlds screen writes a backup file you keep. Deleting a world asks you to confirm first.
7. Updates and availability
We may update, change or discontinue the game, its features, or any part of it at any time. We do not promise that the game will be available without interruption or free of bugs, or that it will remain compatible with future devices or Android versions.
8. No warranty
The game is provided "as is" and "as available", without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. Some jurisdictions do not allow the exclusion of implied warranties; where that is so, the exclusion above does not apply to you and any such warranty is limited to the shortest period the law allows.
9. Limitation of liability
To the fullest extent permitted by law, Rafferty Software LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress, profits or goodwill, arising out of your use of or inability to use the game. Our total liability for any claim relating to the game is limited to the amount you paid us for it in the twelve months before the claim arose, or ten US dollars, whichever is greater.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, or for death or personal injury caused by negligence.
10. Ending this licence
You may end this agreement at any time by uninstalling the game. We may suspend or end your licence if you materially breach these Terms — for example by distributing modified builds or by tampering with purchases. Sections 3, 4, 6, 8, 9 and 11 survive the end of this agreement.
11. Governing law
These Terms are governed by the laws of the State of New Hampshire, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in Belknap County, New Hampshire will have exclusive jurisdiction over any dispute. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer laws of your own country of residence.
12. Changes to these Terms
We may revise these Terms. The revised version will be posted on this page with a new "Last updated" date, and continuing to play after that date means you accept it. If a change is material, it will also be noted in the app's release notes on Google Play.
